Terms of Use

These Terms of Use (hereinafter the “Terms”) govern the conditions and procedures for use of the website accessible at https://www.squaire.tech/ (hereinafter the “Site”), published by Armatis Technology (hereinafter “Armatis Technology”), by any person accessing or browsing the Site (hereinafter the “User”).

Article 1 – Acceptance and amendment of the Terms

Any User acknowledges that they accept the Terms without reservation by the mere fact of using the Site.

The Terms may be modified at any time and without notice by Armatis Technology, in particular to reflect changes to the Site and/or changes in regulations. The new version of the Terms will be made available on the Site. The User declares that they accept the latest version of these Terms each time they connect to the Site.

Article 2 – User commitments

The User agrees to use the Site in accordance with these Terms and with applicable regulations.

The User acknowledges that they take all necessary measures to protect their computer system against contamination by viruses and against any attempted intrusion by third parties.

The User is solely responsible for any loss or damage, whether tangible or intangible, that may result from use of the Site.

The User agrees not to use the Site to display, download, send, transmit, publish or distribute any item or hyperlink containing, without this list being exhaustive, any content that is:

• violent, obscene, pornographic, or likely to undermine respect for and the dignity of the human person, equality between women and men, or the protection of children and adolescents;
• encouraging the commission of crimes or offenses;
• inciting the consumption of illicit substances;
• inciting discrimination, hatred or violence on grounds of race, ethnicity or nationality;
• illegal, insulting, threatening, abusive, defamatory, disparaging, harassing, or constituting an invasion of the privacy of others;
• damaging to the image of Armatis Technology;
• likely to infringe or violate the rights of third parties and/or of Armatis Technology with regard to trade secrets, confidentiality or, more generally, any industrial or intellectual property right;
• containing computer viruses or any other code or program likely to interrupt, destroy or limit the functionality of the Site or of any software, computer or telecommunications tool.

The User agrees to respect the integrity of the Site. The User shall not obstruct or force the operation of the Site, modify, alter or delete content accessible through the Site, and/or fraudulently introduce data on the Site.

More generally, the User is solely responsible for their use of the Site and of the content accessible through it.

Article 3 – Accessibility

The Site is accessed via the Internet. The User declares that they accept the characteristics and limitations of the Internet and acknowledges that they are aware of the nature of the Internet network, in particular its technical performance, the response times for consulting, querying or transferring information, the risks of interruption, and more generally the risks inherent in any connection and transmission over the Internet.

Armatis Technology shall not be held liable in the event of force majeure, malfunction of the network and/or servers, breakdowns and/or maintenance work necessary for the proper operation of the Site, or any other event beyond its control.

Article 4 – Intellectual property rights

The entire Site and each of its components, in particular texts, trademarks, logos, animated or still images, databases, sounds, photographs, know-how, products and services (hereinafter the “Elements”), are protected by intellectual property rights of which Armatis Technology is the owner or a duly authorized user. The trademarks and logos shown on the Site are the property of their respective owners.

Accordingly, all intellectual property rights, including the rights of exploitation and extraction on any medium, and the rights of reproduction, representation, distribution, modification, adaptation or translation of all or part of the Site and/or the Elements, are exclusively reserved to Armatis Technology.

Any reproduction, representation, modification, distribution, adaptation, translation, integration into other elements or transfer to another website of all or part of the Elements is strictly prohibited without the prior written authorization of Armatis Technology (contact@abc.armatis.com).

Any reproduction that has been previously and expressly authorized must include the following mention: “Source: SquAire Tech website, www.squaire.tech”, together with the date of consultation.

Article 5 – Hyperlinks

The Site may contain hyperlinks redirecting the User to third-party websites not published by Armatis Technology. As Armatis Technology exercises no control over these sites, it shall under no circumstances be held liable for the content published on these third-party sites or for any resulting damage to the User.

Any creation or insertion of a hyperlink pointing to this Site requires the prior written authorization of Armatis Technology (contact@armatis.com). Armatis Technology may withdraw this authorization at any time if the link does not comply with applicable law or with these Terms.

Article 6 – Personal data and cookies

The User is invited to consult the Data Protection and Cookie Policy, which governs how their personal data is collected and processed and how cookies are placed.

Article 7 – Warranties and liability

Through the Site, Armatis Technology presents its activities, its range of services and its solutions. The information is provided for general information purposes, without any guarantee of suitability for a particular need, and must not be regarded as specific recommendations.

The User is invited to carry out all appropriate verifications and is solely responsible for their use of the information and content available on the Site. Use of the Site is not covered by any warranty.

Under no circumstances shall Armatis Technology be held liable for clerical errors that may have crept into the documents, data and other content on the Site, despite the care taken in publishing them.

Article 8 – Governing law and jurisdiction

These Terms are governed by French law.

By express agreement, and failing amicable resolution, any dispute arising from the application of these Terms shall be submitted to the Paris Commercial Court (Tribunal de Commerce de Paris), the court of the place where Armatis Technology is registered (RCS Paris 790 093 355), to which territorial jurisdiction is granted, including in the event of summary proceedings, multiple defendants, third-party joinder or warranty claims.
